1. General
1.1. My PrEP Locator (“Platform”) is operated by the Malaysian AIDS Council, in collaboration with the Centre of Excellence for Research in AIDS, where the Platform was initially started.
1.2. In these Terms of Use (“Terms”):
- “You” / “Your” / “Member” refers to anyone accessing or using the Platform
- “We”, “Us”, or “Our” refers to Malaysian AIDS Council
1.3. By accessing or using this Platform, You confirm that You have read, understood, and agreed to these Terms. If You do not agree, please do not use the Platform.
1.4. These Terms govern Your use of the Platform, including its directory, booking system, sexual risk assessment, and mental health assessment services (“Services”).
1.5. You must be at least 18 years old to register and use the full features of the Platform.
2. About the Services
2.1 Directory & Booking System
2.1.1. The Platform provides a location-based directory of clinics and healthcare providers offering HIV Pre-Exposure Prophylaxis (“PrEP”) in Malaysia.
2.1.2. The Platform is for information and access purposes only and does not replace medical consultation, diagnosis, or treatment.
2.1.3. Healthcare providers listed (“PrEP Providers”) are independent professionals or institutions. They are not employees or representatives of Malaysian AIDS Council.
2.1.4. We do not control or influence:
- The quality of care provided
- Medical advice given
- Availability of services
2.1.5. Information on providers may change over time, and availability is not guaranteed.
2.1.6. Using this Platform does not limit You to only the providers listed. You are free to seek care elsewhere.
2.1.7. The Services may not be suitable for every individual or situation.
2.2 Sexual Risk Assessment
2.2.1. This tool provides a general indication of sexual health risk and is not a medical diagnosis.
2.2.2. If You are concerned about Your results, please consult a qualified healthcare professional.
2.3 Mental Health Assessment
2.3.1. This tool provides a general indication of mental health status and is not a diagnosis.
2.3.2. If results are concerning, You are encouraged to seek professional support.
3. Your Account
3.1. You may register for an account to access booking and assessment features.
3.2. You are responsible for:
- Keeping Your login details secure
- All activities under Your account
3.3. You agree that all information You provide is:
- Accurate
- Up-to-date
- Complete
3.4. Your account is for personal use only and must not be used on behalf of others.
3.5. We may suspend or terminate Your account if:
- False information is provided
- These Terms are violated
4. Use of the Platform
4.1. You agree to use the Platform in accordance with Malaysian laws and regulations.
4.2. These Terms are governed by the laws of Malaysia.
5. Privacy, Data & Security
5.1. We comply with the Personal Data Protection Act 2010 (PDPA).
5.2. By using the Platform, You consent to the collection and use of Your data to:
- Provide Services
- Improve the Platform
- Communicate relevant information
5.3. The Platform may use geolocation services (via third-party providers) to show nearby services. By using this feature, You agree to this data usage.
5.4. You must notify Us immediately if You suspect:
- Unauthorised access
- Security issues with Your account
5.5. We are not responsible for losses arising from unauthorised use of Your account.
5.6. You must not access another person’s account.
6. Third-Party Links
The Platform may contain links to external websites. We are not responsible for how these third parties handle Your data or their content. Please review their terms and privacy policies separately.
7. Disclaimer & Responsibility
7.1. While We aim to ensure that listed providers are credible, We do not guarantee:
- Accuracy of information
- Quality of care
- Suitability of services
7.2. Any decisions You make based on information from the Platform are Your responsibility.
7.3. You agree to indemnify and hold harmless Malaysian AIDS Council and affiliated partners from any claims, losses, or damages arising from:
- Your use of the Platform
- Breach of these Terms
8. Changes to These Terms
8.1. We may update these Terms from time to time.
8.2. Continued use of the Platform means You accept any updates.
1. General
1.1. Please read these Terms of Use (“Terms”) carefully. By accessing or using My PrEP Locator (“Platform”), you agree that you have read, understood, and accepted these Terms, including any referenced policies. If you do not agree, you must not use the Platform.
1.2. The Platform is operated by the Malaysian AIDS Council, in collaboration with the Centre of Excellence for Research in AIDS, where the Platform was initially established.
1.3. In these Terms:
- “You” or “PrEP Provider” refers to any registered or prospective healthcare provider or healthcare institution using the Platform
- “Member” refers to registered users of the Platform
- “We”, “Us”, or “Our” refers to Malaysian AIDS Council
1.4. These Terms govern your access to and use of the Platform, including the provider dashboard, clinic directory, booking system, and related digital services (“Services”).
1.5. The Platform facilitates access for Members to healthcare services, including medical consultation, clinical assessment, prescription of medication, and other related services (“Care”) provided independently by PrEP Providers.
2. Provider Registration and Account
2.1. Upon successful registration, you will be issued a provider account (“Account”).
2.2. You are responsible for maintaining the confidentiality and security of your Account credentials, including username and password.
2.3. You represent and warrant that all information provided is accurate, complete, and up to date, and you agree to promptly update any changes.
2.4. Your Account is intended solely for your own professional use. You shall not permit access or use by any unauthorised third party.
3. Panel Clinic Eligibility
3.1. Access to the Platform and listing as a “Panel Clinic” is subject to:
- Acceptance of these Terms
- Compliance with all applicable laws and regulations
- Completion of any required HIV, PrEP, and/or PEP training as determined by Us
3.2. Only providers who meet the above criteria will be listed as Panel Clinics on the Platform.
4. Provision of Care
4.1. You shall be solely responsible for providing all resources necessary to deliver Care, including personnel, equipment, and materials, at your own cost.
4.2. Any services or responsibilities reasonably required for proper delivery of Care shall be deemed included, even if not explicitly stated.
4.3. You shall ensure that all Care is delivered:
In accordance with applicable laws, regulations, and professional standards
With due care, skill, and diligence
4.4. All clinical decisions, treatment plans, and patient management remain your sole responsibility.
5. Booking System
5.1. The Platform includes a Booking System that enables Members to request appointments with PrEP Providers.
5.2. You may opt to enable the Booking System during registration or by submitting a request to Us.
5.3. Upon enabling the Booking System, you agree to:
Operate your Account in accordance with the provided User Guide
Respond to booking requests within three (3) working days
6. Compliance with Laws and Regulations
6.1. These Terms shall be governed by and construed in accordance with the laws of Malaysia.
6.2. You agree to comply with all applicable laws, regulations, and professional standards in Malaysia and any relevant jurisdictions.
6.3. You must be a duly registered and licensed healthcare provider or institution under applicable laws.
6.4. You are responsible for ensuring that all Care provided complies with all relevant legal and regulatory requirements.
7. Data Protection, Privacy, and Confidentiality
7.1. You agree to comply with the Personal Data Protection Act 2010 (PDPA) and all applicable data protection requirements.
7.2. You shall take all necessary measures to protect Member data, including medical and personal information.
7.3. You must immediately notify Us of:
- Any unauthorised access to your Account
- Any suspected or actual data breach
7.4. You shall not access or use the Account or data of any other Member or provider without authorisation.
7.5. We shall not be liable for any loss arising from unauthorised access to your Account.
8. Termination
8.1. You may terminate your Account at any time by submitting a written request. Termination will take effect within seven (7) working days upon confirmation.
8.2. Upon termination, you remain responsible for fulfilling all obligations relating to ongoing Care for Members under your management.
8.3. We reserve the right to suspend or terminate your Account if:
- False or misleading information is provided
- You breach these Terms
9. Indemnification
9.1. You agree to indemnify and hold harmless the Platform, Malaysian AIDS Council, its affiliates, and associated personnel from any claims, liabilities, damages, or losses arising from:
- Your negligence, misconduct, or professional malpractice
- Breach of these Terms
- Failure to protect confidential or personal data
- Non-compliance with PDPA or applicable laws
- Unauthorised disclosure of information
- Misuse of the Platform or its services
10. Miscellaneous
10.1. We reserve the right to amend these Terms at any time. Continued use of the Platform constitutes acceptance of such changes.
10.2. You are an independent provider and shall not represent yourself as an agent or representative of the Platform without prior written approval.
10.3. We reserve the right to audit provider records within the Platform for the purpose of ensuring compliance and quality of Care.
10.4. You may provide services to other organisations, provided such engagements do not conflict with your obligations under these Terms.
